Do You Need Probate in Florida?

Probate is a court-supervised process used to identify estate assets, resolve proper claims and expenses, and transfer property to the people legally entitled to receive it. Whether probate is necessary depends on how the decedent owned property, whether valid beneficiary or survivorship designations exist, and the nature and value of the assets involved.

A will does not automatically avoid probate. The will generally directs the administration of assets that are subject to probate. Some property may pass outside probate, while other property may require a court proceeding before it can be transferred.

Formal Administration

Formal administration is Florida’s traditional probate process. It may be appropriate when an estate does not qualify for a simplified procedure, when a personal representative must be appointed to act for the estate, or when the administration involves creditor claims, real property, multiple beneficiaries, or other issues requiring ongoing court supervision.

Summary Administration

Summary administration is a simplified procedure that may be available when the value of the estate subject to administration in Florida, less exempt property, does not exceed $75,000, or when the decedent has been dead for more than two years. Eligibility does not necessarily mean that summary administration is the best option in every case. The assets, debts, beneficiaries, and practical steps needed to transfer property should be reviewed before filing.

Ancillary Administration

Ancillary administration may be needed when a person who lived outside Florida died owning Florida real estate or other Florida property. The appropriate procedure may depend on the Florida assets and the proceedings opened in the decedent’s home state or country.

Disposition Without Administration

In limited circumstances, certain personal property may qualify for a procedure known as disposition of personal property without administration. This procedure is narrow and depends on the value and type of property and qualifying final expenses.
